PROPOSED CD1 TO BILL 41 (2026) (Submitted by Councilmember Dos Santos-Tam) – The CD1 (OCS2026-0419/7/9/2026 1:19 PM) makes the following amendments: A. In SECTION 4 of the bill, amends the definition of "Motor" by adding the term "motor-driven cycle." B. Adds a new SECTION 5 to the bill to make conforming amendments to ROH Section 15-6.7 regarding electric foot scooters and electric micro-mobility devices within bikeways. Renumbers subsequent SECTIONS accordingly. C. In renumbered SECTION 6 of the bill (formerly SECTION 5), revises ROH Section 15-13.11(c) to prohibit a person from: (1) parking a moped in a bicycle rack located on a sidewalk unless signage so permits; or (2) driving the moped on a sidewalk in violation of HRS Section 291C-196(c). D. Moves SECTION 8, which adds a new section to Chapter 15, Article 18, entitled "Riding on bikeways," to SECTION 13 to conform to drafting style conventions, and renumbers subsequent SECTIONS accordingly. E. In renumbered SECTION 8 of the bill (formerly SECTION 7): 1. Deletes the proposed language in ROH Section 15-18.7(b) and restores the existing language of ROH Section 15-18.7(b), with nonsubstantive revisions; 2. Deletes the proposed language in ROH Section 15-18.7(c) and replaces it with the following: "Except where prohibited pursuant to subsections (a) and (b), a person may ride a bicycle, including a class 1, class 2, or class 3 electric bicycle, upon a sidewalk; provided that: (1) The speed of travel does not exceed 10 miles per hour; (2) The person yields the right-of-way to pedestrians; and (3) The person gives an audible signal before overtaking or passing any pedestrian.:"; and 3. Deletes subsection (d). F. In SECTION 9, amends ROH Section 15-18.10(a)(20) to repeal the prohibition against possessing intoxicating beverages within the limits of bicycle paths and their respective easements. G. In SECTION 10 of the bill, substitutes all of the proposed language in ROH Section 15-18.11, subsections (a) though (d), and replaces it with the following: "The operation of electric bicycles is governed by HRS §§ 291C-143 and 291C-143.5, and all other applicable law." H. In renumbered SECTION 13 (formerly SECTION 8): 1. Revises the proposed language in subsection (a) to clarify that the exceptions referenced in HRS Section 291C-123 are only those that are numbered and do not include mopeds; and 2. Deletes the proposed language in subsection (c) and replaces it with the following: " For purposes of this section, "electric motorcycle" means a two- or three-wheeled vehicle equipped with an electric motor capable of exceeding a speed of twenty-eight miles per hour on level ground, and that may be legally operated on public roadways under the same licensing, registration, and insurance requirements applicable to motorcycles under state law." I. Makes miscellaneous technical and nonsubstantive amendments.
